El vocero del bloque de diputados del Partido de la Liberación Dominicana llamó a la Dirección General de Compras y Contrataciones Públicas cancelar con carácter de urgencia varios procesos de licitación convocados de “urgencia” por la Oficina para el Reordenamiento del Transporte (OPRET), para la construcción de la Línea 2-C del Metro de Santo Domingo por un monto de 2 mil millones de pesos (RD$2,000,000,000,00).
Gustavo Sánchez dijo que la convocatoria a cuatro licitaciones mediante el procedimiento de “urgencia” entra en contradicciones con varios artículos de la Ley 340-06 y su reglamento, los cuales dejan bien claro en cuales circunstancias aplica esa modalidad de excepción de licitación.
Para la construcción de la Línea 2-C que va desde la estación María Montes en el kilómetro 9 de la Autopista Duarte hasta Los Alcarrizos, la entidad contratante ha utilizado un procedimiento de licitación que llama poderosamente la atención y que por su complejidad no aplica para este tipo de contratación, sustentó Sánchez.
El programa Nuria Investigación Periodística dio a conocer el pasado fin de semana un trabajo sobre el llamado de la Opret a una licitacion de urgencias para la ampliación de línea 2-C del Metro.
En ese sentido, el congresista recordó que la Ley 340-06 define las urgencias como situaciones de caso fortuito, inesperadas, imprevisibles, inmediatas, concretas y probadas, en las que no resulta posible la aplicación de los procedimientos de selección establecidos en la ley, en tiempo oportuno, cuyas exigencias no aplican para este procedimiento.
“Además queremos llamar la atención que la documentación que justifique la selección del mecanismo de “urgencia”, no figura como parte del Pliego de Condiciones publicado en el portal de compras de la OPRET, lo que constituye otra violación a la ley de Compras y Contrataciones”, dijo Gustavo Sánchez en una rueda de prensa en el bloque del PLD en la Cámara de Diputados.
Sobre la base de este criterio legal, el legislador informó también que solicitará vía el Portal Único de Solicitud de Acceso a la Información Pública, la resolución motivada de la máxima autoridad ejecutiva de la OPRET que recomienda el uso de la excepción, el informe pericial que lo justifica y las situaciones de caso fortuito, inesperadas, imprevisibles, inmediatas, concretas y probadas, por lo que resulta imposible la aplicación de los procedimientos de selección establecidos en la ley.
Sánchez destacó que junto a un equipo de técnicos y juristas pudieron encontrar en las citadas licitaciones de urgencia realizadas por la OPRET, varias violaciones a la ley y su reglamento de aplicación, tales como el numeral tres del artículo 3, numeral dos del artículo 4 y los artículos 68 y 69 del Reglamento de aplicación de la Ley de Compras y Contrataciones Públicas, así como el numeral tres del artículo 3, relativo al principio de transparencia y publicidad establecido en la Ley 340-06.
Las licitaciones declaradas de urgencia son, el procedimiento OPRET-MAE-PEUR-2021-0001, OPRET-MAE-PEUR-2021-0002, OPRET-MAE-PEUR-2021-0003 y OPRET-MAE-PEUR-2021-0004, las cuales fueron denunciadas en el programa de televisión Nuria Investigación Periodística.
