El balance del 2021 es positivo para la República Dominicana. El pueblo dominicano una vez más ha mostrado su capacidad para enfrentar la adversidad y el año termina con una prometedora recuperación lograda de manera colectiva, tanto en la lucha contra el COVID-19, como en la reactivación económica, a pesar de los factores adversos que todavía persisten.
El 2021 también será recordado por el inicio del fin de la impunidad y por comenzar a dar frutos la lucha contra la corrupción que por décadas ha dominado la vida nacional.
Santo Domingo, República Dominicana. Participación Ciudadana, Capítulo dominicano de Transparencia Internacional presentó el balance del año 2021, a través del cual señaló que el 2021 será un año para recordar. Primero, por ser el segundo año de lucha contra la pandemia del COVID-19, la cual ha estremecido al mundo y a nuestro país; y segundo, ya que después de cuatro periodos consecutivos de gobiernos del Partido de la Liberación Dominicana (PLD) este es el primer año completo del gobierno del Partido Revolucionario Moderno (PRM), cuya principal contribución hasta ahora es el logro de un Ministerio Público independiente.
El balance del año presentado, a través de rueda prensa por la organización de la sociedad civil subraya, además que en la lucha contra la pandemia el gobierno ha realizado un arduo y efectivo trabajo de prevención, con un amplio y oportuno programa de vacunación y educación ciudadana, así como también en los servicios hospitalarios, que, a pesar de contar con un servicio de salud deficiente, lograron atender adecuadamente a las personas afectadas por la enfermedad, por otro lado, se continuó con el programa de ayudas sociales.
“El año transcurrió entre numerosas expectativas de cambios prometidos por el nuevo gobierno, abundancia de concertaciones, anuncios de reducción de gastos y diversas disposiciones presidenciales cuyos frutos están todavía por expresarse y consolidarse. Catorce importantes reformas fueron anunciadas, y están en proceso de diseño y estudio en el ámbito del Consejo Económico y Social (CES). Se puede afirmar que la figura del presidente y algunos miembros de su gabinete han logrado imprimir a este primer año un sello de apertura democrática”, destacaron.
La lucha contra la corrupción y la impunidad
El enorme esfuerzo en la lucha contra la corrupción desplegado por el Ministerio Público fue el principal aspecto positivo durante todo el año 2021.
La medida adoptada el primer día del actual gobierno de designar a la magistrada Miriam Germán Brito como Procuradora General de la República, a Yeni Berenice Reynoso al frente de la Dirección General de Persecución y a Wilson Camacho, magistrados/as en la Procuraduría Especializada de Persecución de la Corrupción Administrativa ha dotado al país de un equipo de personas apartidistas, independientes, laboriosas y capacitadas que con sus acciones han dejado claro que la corrupción pública será perseguida sin distinción de colores partidarios.
La labor del ministerio público durante 2021 ha permitido demostrar que los fiscales pueden trabajar con independencia, incluyendo casos de funcionarios activos, como los cinco expedientes de enorme proporción y relevancia que se han presentado este año:
1. La “Operación Antipulpo” con once imputados, encabezados por Alexis Medina, hermano del ex presidente de la República Danilo Medina, la cual involucra fondos por más de cuatro mil millones de pesos.
2. “Operaciones Coral y Coral 5 G”, que involucran por lo menos a cuatro generales, entre ellos los dos principales responsables de la seguridad del ex presidente Danilo Medina, acompañados por al menos siete coroneles y otros militares, sobre todo de la Fuerza Aérea Dominicana. El caso involucra miles de millones de pesos.
3. La “Operación Medusa”, cuyo principal imputado y preso es el ex Procurador General de la República, Jean Alain Rodríguez, junto a varios funcionarios que lo acompañaron en su gestión, acusados de delitos de asociación de malhechores, estafa contra el Estado, soborno, coalición de funcionarios, falsedad de documentos públicos, robo de identidad, delitos electrónicos y lavado de activos.
4. La “Operación Falcon”, la cual involucra a 23 imputados, incluyendo varios militares de alto rango acusados de crear una extensa red de lavado de activos provenientes del narcotráfico que manejó millones de dólares y traficó miles de kilos de cocaína desde Sudamérica hasta Estados Unidos, Puerto Rico y Europa.
5. La “Operación 13”, encabezada por el imputado Luis Maisichell Dicent, quien era administrador de la Lotería Nacional designado por el actual gobierno. Fue destituido y sometido a la justicia, acusado de un fraude en al menos un sorteo, por un monto superior a los 500 millones de pesos.
Corrupción y malas prácticas en el presente año
La labor del Ministerio Público durante 2021 ha permitido demostrar que los fiscales pueden trabajar con independencia, incluyendo casos de funcionarios y funcionarias activos como los que se han presentado este año.
A pesar de las promesas, las advertencias y el compromiso del presidente Luis Abinader en la lucha contra la corrupción en este año varios funcionarios y funcionarias de su gobierno han sido acusados de manejo incorrecto y corrupción en la función pública. Algunos casos están en manos del Ministerio Público para ser investigados como son los casos del Instituto Nacional de Bienestar Estudiantil (INABIE), del Instituto Postal Dominicano (INPOSDOM), caso de la Lotería Nacional y caso del Ministerio de la Juventud. Es importante consignar que el presidente Luis Abinader ha actuado de manera correcta en estos casos, suspendiendo o destituyendo a los funcionarios, pero también estos deben ser debidamente investigados por el PEPCA. La destitución o suspensión no es un paliativo. Los casos más destacados son:
1. Kimberly Taveras, ministra de la juventud. Suspendida y obligada a renunciar por la opinión pública, investigada luego de que no pudo demostrar su patrimonio por RD$106 millones de pesos.
2. Cecilio Rodríguez, director del Instituto de Bienestar Estudiantil (INABIE), fue destituido luego de ser acusado de otorgar cerca de 11,000 mil millones de pesos a 1,260 empresas sin licitación, sin estatus jurídico y sin estar registradas como proveedoras del Estado.
3. Adam Peguero, director del Instituto Postal Dominicano (INPOSDOM). Fue destituido luego de que la Dirección General de Compras y Contrataciones Públicas, Dirección de Ética e Integridad Gubernamental y la Contraloría General, remitieran al presidente Abinader un expediente sobre la adjudicación de un contrato sin concurso a la empresa M Cargo.
4. Víctor Miguel Polanco Severino, Viceministro de Control y Regulación de Armas y Municiones del Ministerio de Interior y Policía. Destituido luego de ser acusado de venta ilegal de armas.
5. Miguel Mateo Familia, director de Recursos Humanos del Ministerio de Salud Pública. Destituido luego de ser acusado de dar continuidad al negocio de venta de nombramientos que desde hace décadas se viene denunciando en ese Ministerio.
6. Tony Peña Guaba, coordinador de los Programas Sociales de la Presidencia. Fue duramente criticado por entregar, a su discreción, 100 millones de pesos en diciembre del 2020 a 67 directores de orquestas, músicos y cantantes.
7. Plutarco Arias, ministro de salud. Destituido luego de que se denunciara la compra de jeringuillas con una sobrevaloración de 400%. El Estado las iba a comprar a RD$25.00 cuando en el mercado estaban a RD$4.70.
8. Julio Antonio de la Cruz Nolasco, director general de Embellecimiento de Carreteras. Fue sustituido luego de que se denunciaran graves irregularidades.
9. Feyla Rodríguez Pavón, gerente de Portuaria, más cinco empleados, están bajo investigación por fraude en transacciones en el muelle de Puerto Plata.
10. Antonio Gómez Díaz, director de Aduanas en Santiago, quien fue destituido por violencia de género y acoso sexual.
11. La “Operación Caracol”, investigación en curso en la Procuraduría Especializada en Persecución de la Corrupción Administrativa (PEPCA), involucra al anterior presidente de la Cámara de Cuentas, Hugo Francisco Álvarez Pérez, por los delitos de obstrucción de la justicia, coalición de funcionarios, falsificación de documentos públicos, asociación de malhechores, complicidad en diferentes tipos de desfalco, estafa contra el Estado y lavado de activos provenientes de actos de corrupción.
12. Juan Maldonado Castro, director general de Comunidad Digna, quien fue destituido tras ser implicado en el lavado de activos provenientes del narcotráfico.
13. Cancelación de Luz del Alba Jiménez, ministra de la juventud, luego de iniciar una investigación a cargo de la Dirección General de Compras y Contrataciones, Dirección de Ética e Integridad Gubernamental y Contraloría General sobre un concurso para comprar equipos en ese ministerio.
14. Cancelación del Cónsul en Juana Méndez, José Altagracia Valenzuela, tras ser acusado de venta de visas.
La Cámara de Cuentas comienza a contar
Uno de los acontecimientos positivos del 2021 fue la designación de una Cámara de Cuentas integrada por personas independientes, y con un excelente historial profesional y personal. El país se regocijó ante la esperanza de que terminen décadas de inutilidad, encubrimiento y complicidad por parte de un organismo llamado a contralor y fiscalizar los recursos públicos. La esperanza nacional ha comenzado a concretizarse en las auditorias que involucran manejos fraudulentos, y violaciones a las leyes que superan con mucho los rumores y advertencias de corrupción que desde hace años se denunciaban en el país. En las últimas semanas se han dado a conocer informes de auditorías que comprometen a la Oficina de Ingenieros Supervisores de Obras del Estado (OISOE), Ministerio de Salud Pública, Empresa Distribuidora de Electricidad del Este (EDESTE), Ministerio de Obras Públicas y Comunicaciones (MOPC), la Policía Nacional, el Fondo Patrimonial de las Empresas Reformadas (FONPER), entre otros.
Otra institución que ha hecho un destacado trabajo en el año es la Dirección Nacional de Control de Drogas (DNCD), la cual ha dado fuertes golpes al tráfico de estupefacientes en el país.
La Dirección de Ética e Integridad Gubernamental, así como la Dirección General de Contrataciones Públicas y la Contraloría General han cumplido con su función investigando las denuncias y haciendo las recomendaciones correspondientes.
Como parte del fortalecimiento institucional se designó a personas con carácter de independencia y capacidad en el Tribunal Superior Electoral, así como también el Defensor del Pueblo.
Es significativo que el Ministerio Público ha demostrado tener la valentía para enfrentar casos de corrupción tradicionales, pero que nadie se atrevía a investigar, como por ejemplo los que ocurrían en las Fuerzas Armadas. Con las operaciones Coral y Coral 5 G, se ha puesto en evidencia un sistema de corrupción que opera en las distintas instituciones castrenses desde hace muchos años, que incluye sustraer fondos que nunca se auditaban bajo la excusa de que se utilizaban para inteligencia. Además, otorgar “especialismos” a militares de bajo rango, que luego tienen que desprenderse de casi la totalidad de estos fondos para pasarlos a sus superiores, en una escalera que llegaba a lo más alto, en casos que involucran a organismos como el Centro Especializado de Seguridad Turística (CESTUR), el Cuerpo Especializado de Seguridad Presidencial (CUSEP), y hasta el Consejo Nacional para la Niñez y la Adolescencia (CONANI), los cuales se encuentran debidamente documentados en la solicitud de medidas de coerción interpuesta por el Ministerio Público.
Destacada labor en la Dirección General de Compras y Contrataciones Públicas (DGCP)
Esta fue otra función en la que el nuevo gobierno decidió colocar personas independientes, no solo de los partidos políticos sino además del sector privado y de la sociedad civil, designando a Carlos Pimentel, quien trabajó por varios años los temas de transparencia desde Participación Ciudadana, llegando a ser su director ejecutivo.
La DGCP expandió la capacitación a los funcionarios municipales en los temas de compras y contrataciones públicas. Ha continuado los esfuerzos para incorporar como suplidores del Estado a las MIPYMES y a las mujeres. Se estableció un sistema integral de monitoreo y análisis de datos con la finalidad de detectar en forma temprana las instituciones que incurren en violación a la ley en sus procesos de adquisición de bienes y servicios. Además, se preparó un anteproyecto de ley de compras y contrataciones para modificar la ley vigente con la finalidad de llenar el enorme vacío de falta de sanciones a quienes la violan.
Lo más importante desde el punto de vista político e institucional es la independencia que ha mostrado la Dirección de Contrataciones Públicas a la hora de actuar. Un ejemplo reciente ha involucrado a un senador del partido oficialista, el señor Arístides Victoria Yeb, de quien la periodista Alicia Ortega documentó prácticas violatorias de la ley que le prohíbe ser suplidor del Estado. En una demostración de independencia, la DGCP confirmó que el senador había suplido al Estado a través de compañías que controlaba.
La independencia como línea central en la selección de altas cortes
Habiendo logrado la independencia del Ministerio Público, el Consejo Nacional de la Magistratura (CNM) se estableció como meta obtener el mismo resultado en la Cámara de Cuentas, en la Junta Central Electoral y en el Tribunal Superior Electoral donde se realizaron procesos de selección transparentes y bien conducidos.
Los trabajos del CNM lograron el propósito buscado al seleccionar en la Cámara de Cuentas a cinco personas independientes en las personas de Janel Andrés Rodríguez Sánchez, presidente; Elsa María Catano Ramírez, vicepresidenta; Tomasina Tolentino de Mckenzie, secretaria; Mario Arturo Fernández Burgos y Elsa Peña Peña, miembros.
En la Junta Central Electoral (JCE) fueron seleccionados Román Andrés Jáquez Liriano, presidente; Rafael Armando Vallejo Santelises, Dolores Altagracia Fernández Sánchez, Patricia Lorenzo Paniagua y Samir Rafael Chami Isa.
En el Tribunal Superior Electoral (TSE) fueron designados Ygnacio Pascual Camacho Hidalgo, presidente; Juan Alfredo Biaggi Lama, Rosa Fiordaliza Pérez, Pedro Pablo Yermenos Forastieri y Fernando Fernández Cruz.
Dos aspectos sobre estas selecciones son: el primero positivo es el precedente de recurrir a jueces de carrera del Poder Judicial para su designación en estos órganos, mejorando así las posibilidades de independencia. El segundo aspecto, negativo es el desbalance de género en las designaciones sobre todo en el TSE en claro desprecio del artículo 39.5 de la Constitución de la República, el cual establece el deber de promover y garantizar la participación equilibrada de mujeres y hombres en las instancias de dirección y decisión del ámbito público.
Corresponderá a los designados demostrar que la ciudadanía está mejor protegida con personas independientes de los partidos y otros sectores en estos órganos constitucionales. Las actuaciones del Ministerio Público llevarán a los tribunales casos de suma relevancia en los próximos años. Les tocará a éstos comportarse a la altura que el país requiere y completar el circulo virtuoso que ponga fin a la impunidad y reduzca la corrupción.
Aumenta la confianza
Las actuaciones del Ministerio Público contra funcionarios, militares y capos de la droga, reforzados ahora por las auditorias de la Cámara de Cuentas, las decisiones de Compras y Contrataciones y de la Contraloría General junto a la rápida destitución y puesta a disposición de la justicia de funcionarios del actual gobierno han aumentado la confianza en que el país podrá superar el lastre de corrupción sin castigo.
Los esfuerzos en la lucha contra la corrupción en el último año han permitido mejorar los índices de República Dominicana en esta materia, como por ejemplo el índice 2021 de Américas Society/Council of the Americas y Control Risk, que mide la capacidad de 15 países latinoamericanos para combatir la corrupción (CCC). República Dominicana fue el país con mayor avance en esta materia, al mejorar de un 3.26% a un 4.38%, pasando del lugar 13 al 10, pero aún lejos del 7.80 obtenido por Uruguay, el país mejor ranqueado.
Latinobarómetro en su más reciente informe del 2021 da cuenta de que la percepción de la corrupción bajó de 83 a 54 y la democracia subió 6 puntos, al llegar de 44 a 50 puntos.
Después de décadas en las que las instituciones creadas para prevenir, controlar y perseguir la corrupción se convirtieron en parte o cómplices del asalto al erario que se evidencia en numerosos expedientes, investigaciones y denuncias, es necesario destacar algunos cambios que la ciudadanía espera sean de largo plazo. La promesa del presidente se ha expresado en el nombramiento de personas independientes, comprometidas y con el coraje para enfrentar la corrupción, como son los casos de la Procuraduría General de la República, incluyendo sus fiscalías especializadas en persecución de la Corrupción, la Dirección General de Ética e Integridad Gubernamental, Dirección General de Compras y Contrataciones Públicas, Contraloría General de la República y Cámara de Cuentas. En este año esas instituciones han hecho un destacado trabajo cumpliendo los roles estipulados en las leyes y creando la expectativa ciudadana de que estamos en el camino de reducir esos terribles males de corrupción e impunidad que tanto han dañado al país.
El caso ODREBRECHT; un fracaso nacional
El fracaso nacional mayor fue el caso ODEBRECHT. A pesar del notable esfuerzo del Ministerio Público actual, el 2021 fue testigo de un gran fracaso cuando este caso, iniciado en 2017 con catorce imputados, de los cuales seis llegaron a juicio de fondo terminó en primer grado con solo dos condenados: Ángel Rondón a ocho años y Víctor Díaz Rúa a cinco. Solo Ángel Rondón fue condenado por soborno, sin que hasta ahora se haya podido identificar y llevar a la justicia a ningún funcionario público, a pesar de que la misma empresa confesó que había pagado sobornos.
Desde el principio, mucha gente, incluyendo nuestra organización, y en especial la magistrada Miriam Germán hicieron notar la seria negligencia del Procurador General de la República anterior, Jean Alain Rodríguez, quien no gestionó las pruebas pertinentes en Brasil como hicieron otros países.
La periodista de investigación, Alicia Ortega, reveló el pago de millones de dólares en sobornos a funcionarios ocultos en nombre claves, de los cuales solo tres han podido ser identificados, pero contra ninguno se ha podido presentar acusación. La periodista reveló que una parte importante de estos pagos correspondía a la construcción de la planta eléctrica a carbón Punta Catalina, que no fue incluida en el expediente y todavía no ha sido objeto de acusación por parte del Ministerio Público.
Tratándose del caso más grande de corrupción en toda la historia de la República Dominicana, los resultados fueron decepcionantes y se espera que las nuevas autoridades del Ministerio Público puedan subsanar esa negligencia con la presentación de una verdadera investigación sobre el caso ODEBRECHT y, sobre todo de Punta Catalina.
Un balance negativo para el Congreso Nacional
El 2021 confirmó la sospecha de que el Congreso Nacional ha resultado en una gran frustración para los sectores que aspiran a una mejoría de la democracia, la transparencia, la defensa de los derechos ciudadanos y el fortalecimiento institucional. A pesar del esfuerzo que realizó la sociedad civil en procura de la elevación de la calidad del primer poder del Estado, muy pronto se ha notado la prevalencia de intereses particulares, el dominio de posiciones atrasadas y conservadoras, además de un comportamiento cuestionable por parte de muchos legisladores.
Durante todo el año, el comportamiento de muchos congresistas ameritó la vigilancia constante y protestas diversas de la sociedad civil contra sus intentos de pasar medidas contrarias al sentir nacional, especialmente en el aspecto de la lucha contra la corrupción y en los derechos de las mujeres.
Como acciones positivas del año se registran la aprobación de la Ley que prohíbe el matrimonio infantil, la elección de un Defensor del Pueblo no partidista y una Cámara de Cuentas que en poco tiempo ha marcado una diferencia.
Una de las más importantes quejas contra el Congreso Nacional es el mantenimiento de privilegios que les permiten la continuidad indefinida, en base al clientelismo, costeado con recursos públicos como los barrilitos, exoneraciones, asignaciones especiales varias veces al año y empleados que utilizan en labores proselitistas. Solamente unos pocos legisladores han renunciado a esos privilegios.
La calidad de la representación congresual ha quedado marcada por la situación del diputado oficialista, Héctor Darío Féliz Féliz, que pretendió proteger a un extraditable y a un funcionario público del actual gobierno; Juan Maldonado Castro, director general de Comunidad Digna, quien fue destituido. Al igual que por la detención en el aeropuerto de Miami del también diputado oficialista, Miguel Gutiérrez Díaz y la investigación de que es objeto la diputada oficialista por La Vega, Rosa Amalia Pilarte López, cuyo esposo e hijos han sido detenidos y son investigados por lavado de dinero.
La mayor víctima de la dudosa calidad del Congreso que tenemos ha sido el proyecto de ley de Código Penal. Nadie discute que un código redactado hace cerca de doscientos años requiera una reforma profunda, pero el proyecto ha evidenciado la traición a promesas electorales, tanto del Partido Revolucionario Moderno (PRM), así como de varios diputados y senadores, como fue la de no incluir las tres causales de la interrupción del embarazo, en apoyo a la vida y dignidad de las mujeres. Para dar otro golpe a las mujeres el proyecto contiene una reducción de las penas por violación sexual cuando es producida por la pareja, tema que al ser discutido reveló posiciones verdaderamente vergonzosas por parte de muchos legisladores.
En el proyecto de Código han sido incluidos de contrabando barbaridades como la reinstalación de los tribunales policiales y militares, cuando los mismos, por dos sentencias del Tribunal Constitucional han sido declarados inconstitucionales y limitados exclusivamente al ámbito disciplinario. También se ha intentado reducir las penas aplicables al tipo penal especial de corrupción, así como también despenalizar la discriminación por género u orientación sexual, lo que sería un salto al pasado y una vergüenza mundial para nuestro país, además de que violaría tratados internacionales de derechos humanos.
Otro proyecto que no ha podido avanzar en el Congreso Nacional es el de extinción de dominio, que tiene el propósito de hacer mucho más efectiva la incautación y decomiso de los bienes y activos productos de infracciones. En el Congreso no ha existido voluntad política para lograr que este proyecto sea aprobado, a pesar de que pondría en manos del Ministerio Público una herramienta efectiva para darle a la criminalidad organizada por donde más le duele; en los bolsillos.
Debemos señalar que algunos congresistas han sido coherentes manteniendo sus promesas electorales y han levantado su voz en un acto de genuina representación para defender las posiciones que ofertaron durante la campaña electoral.
Los partidos políticos tienen que hacer un esfuerzo más serio para elegir candidatos y candidatas idóneos para participar en las próximas elecciones, pues el país requiere un congreso fuerte y responsable, que ayude a avanzar en la agenda legislativa rezagada. Lamentamos que el presidente de la República no haya ejercido el liderazgo que posee para lograr que, por lo menos las promesas de campaña sean cumplidas por sus seguidores en el Congreso Nacional. Esto es preocupante, frente a una gran cantidad de reformas que actualmente se diseñan en el Consejo Económico y Social (CES), y que necesariamente deberán ser aprobadas por el Congreso.
Con el arribo del Código Penal al Poder Ejecutivo, el presidente Abinader pondrá a prueba su respeto a la palabra empeñada, ya que fue de los que defendió la inclusión de las tres causales en ese texto legal, y la coherencia que se espera de él debería llevarlo a observarlo ante la ausencia de las tres causales, lo que ya hizo en su momento Danilo Medina.
Por el fortalecimiento de los partidos políticos
El 2021 nos deja de tarea trabajar para fortalecer la democracia y la institucionalidad a lo interno de los partidos políticos, con la finalidad de que mejore la percepción que tiene la ciudadanía sobre ellos. En lo inmediato, los partidos políticos tienen varios retos que pueden ayudar a elevar su imagen y credibilidad. Se hace necesario modificar la legislación electoral y de partidos políticos, en el orden de su fortalecimiento, transparencia, control y democratización.
Los partidos son esenciales en un régimen que se precie de democrático y su debilitamiento, como ha acontecido en este año 2021, representa un serio peligro. Tal es el hecho ocurrido en varios países latinos donde se han instalado regímenes populistas que tienden al autoritarismo siendo los casos más graves los de Nicaragua y Venezuela.
Aunque algunos líderes partidarios han pretendido acusar a la sociedad civil de su debilitamiento por las críticas vertidas al mal comportamiento de miembros de los partidos, la realidad es que trabajar en su fortalecimiento es una tarea urgente. Lo que pasa ineludiblemente por la educación política de sus miembros, que prácticamente todos los partidos han abandonado en una falta de cumplimiento de la ley que los rige.
Mostrar respeto por las leyes y las autoridades es otro reto sumamente importante. Aunque la Junta Central Electoral (JCE) ha advertido que hará cumplir, bajo advertencia de aplicar sanciones, las disposiciones sobre periodos de precampaña, campaña, algunos partidos y líderes políticos ya han iniciado sus campañas abiertas y anunciado que desafiarán los plazos. Evidentemente que esta conducta no contribuye ni a la gobernabilidad, ni a la buena imagen que deberían exhibir organizaciones que aspiran a gobernar el país y que deben ser ejemplo de respeto a las leyes.
Otro importante desafío de los partidos es depurar su membresía, sobre todo los líderes locales y nacionales que aspiran a posiciones electivas y ejecutivas, con el propósito de lograr una oferta de mucho mayor calidad, promoviendo personas con un historial limpio, que sean ejemplo para sus comunidades, con voluntad de cambio, con ideas avanzadas y deseos de servir. El país no puede permitir que la política sea permeada por la delincuencia, los negocios ilícitos, abusadores, discriminadores de las mujeres, entre otros malos ejemplos.
Más que de promover aspiraciones a posiciones electivas estos son tiempos para trabajar a lo interno de los partidos, en la formación de sus miembros, en la actualización de sus normas, en la renovación de sus órganos de dirección y no pretender desafiar al órgano electoral que lo que pretende es aplicar la ley.
La economía dominicana en el 2021
Tras una fuerte caída de las actividades productivas en el 2020, expresada en un decrecimiento de 6.7% del Producto Interno Bruto (PIB), como efecto del cierre y el confinamiento a que condujo la pandemia del COVID-19, la economía dominicana ha sido una de las que más rápidamente se ha venido recuperando en el 2021.
Desde los meses finales del año pasado se inició la recuperación y, en los primeros diez meses del presente año, se estima que la economía creció en 12.4%, hasta el punto de que, tanto las autoridades nacionales como los organismos internacionales han venido proyectando hacia arriba el crecimiento, previsto en 5% al principio y ahora, finalizando el año, lo estiman en más del 10%.
Los sectores que más crecen en el 2021 son justamente los que mayor deterioro sufrieron el año pasado y otros que han recibido un impulso por la propia pandemia. Tal es el caso de la construcción, las zonas francas, la industria y el transporte.
Algunos sectores crecieron en el 2020, a pesar de la pandemia o con la ayuda de las políticas públicas como la agropecuaria, la salud, las comunicaciones, la administración pública y la intermediación financiera, razón por la cual perdieron impulso en el 2021 o sencillamente decrecieron algo.
La construcción ha aumentado cerca del 25% impulsada por un fuerte repunte de la inversión privada en viviendas. También las zonas francas que aumentaron en 22%, la manufactura local en 11% y el comercio en 11.3%, siempre con datos parciales hasta octubre.
El turismo, los viajes y toda la industria del entretenimiento, sector casi totalmente cerrado en el 2020 ha tenido en el 2021 un espectacular crecimiento de 36%. En comparación con el resto del mundo, la República Dominicana se destaca entre los países con más rápida recuperación. Dada la trascendencia del sector para la economía nacional, el Gobierno está poniendo mucho empeño en reactivarlo, aunque todavía los viajes masivos siguen restringidos, países importantes para el turismo dominicano mantienen fuertes restricciones, al tiempo que los protocolos sanitarios y el aumento del transporte elevan los costos.
A medida que la economía se reactiva y la población pierde el miedo de salir en busca de ingresos, la tasa de desempleo que había subido en el 2020, ha mejorado. Los últimos datos disponibles provenientes de las encuestas del Banco Central indican que el volumen de ocupados podría terminar recuperando este año su nivel del 2019.
En realidad, los registros de la seguridad social indican que los empleos formales de octubre 2021 volvieron al nivel de febrero del 2020, con una ligera reducción de empleados públicos, compensado con aumento de los privados (22 mil ocupados más). La tasa de desempleo bajó de 7.1% a 6.8% en el último año, afectando más a los segmentos de menor nivel educativo, a las mujeres (principalmente por el servicio doméstico) y los de menor nivel de ingresos. También mucho más al sector formal que al informal, debido a que este sirve como un amortiguador de las caídas en el empleo.
Además del tema sanitario, el gran problema del país y el mundo en este momento es la inflación. Al abrirse muchas actividades económicas y reactivarse el mercado mundial comenzaron a subir los precios de las materias primas, el petróleo en particular, unido a los grandes costos del transporte por los congestionamientos de puertos y paralización de líneas marítimas y aéreas. Las alzas de precios se extendieron por el mundo. En la República Dominicana la inflación llegó a superar en mayo la tasa de 10% anualizada, y todavía en octubre se mantiene en 7.7%.
Mucha gente entendió que esto era un fenómeno pasajero, pero a los incrementos originales de precios se ha unido un inusitado aumento de los costos de fletes, originados principalmente por la menor capacidad de los puertos, cargueros y furgones para responder a la renovada demanda (la pandemia ocasionó sustitución de consumo de servicios por bienes físicos), dificultando y encareciendo el transporte desde los países orientales, muy particularmente de China, hacia Europa y América, llegando incluso a provocar que en algunos bienes sea más caro el flete que la compra.
Entre las fuentes de divisas, las exportaciones dominicanas de bienes se recuperaron rápidamente, tanto de la industria nacional como de zonas francas, esto por los incrementos de la demanda mundial como por los precios de los productos básicos, incluyendo oro y ferroníquel.
La gran sorpresa fueron los ingresos por remesas, que luego de haber sufrido una sustancial caída en marzo y abril del 2020, comenzaron a crecer a tasas extraordinarias debido a la aplicación de programas masivos de protección social en los países emisores, terminando en el 2020 en US$8,220 millones. Las cifras siguieron sorprendiendo en el 2021, estimándose que al final del año se habrán superado los US$10,000 millones.
Tras haber sufrido una notable devaluación a inicios del 2020, la tasa de cambio se estabilizó y después se revaluó en más del 3% en el presente año, inducido por la política que procura controlar la inflación.
Los limitados ingresos obligaron en el 2021 a una reducción del gasto, tanto en la cobertura como en el monto transferido, de modo que, de un gasto medio mensual de RD$17,400 millones en asistencia social que se produjo en el 2020, se redujo a un promedio de RD$4,066 en los primeros siete meses del 2021. Por otro lado, el gobierno se vio obligado por las circunstancias actuales a posponer la prometida reforma fiscal que aumentaría sus ingresos con la consecuencia de tener que tomar decisiones como suprimir programas sociales, disminuir la cantidad de empleados gubernamentales y recortar hasta el mínimo la inversión pública, provocando un superávit fiscal que se mantuvo por los primeros diez meses del año 2021.
Así, el coeficiente de deuda pública, que se había elevado al 70% con la pandemia, volvió a bajar un poco este año. Aún no se dispone de suficiente información para medir los costos sociales inmediatos y efectos futuros sobre la economía, dado que en tiempos de crisis se desaconseja reducir el gasto fiscal como política macroeconómica y social.
Por otro lado, el gobierno se vio obligado por las circunstancias actuales a posponer la prometida reforma fiscal que aumentaría sus ingresos, con la consecuencia de tener que tomar decisiones como suprimir programas sociales, disminuir la cantidad de empleados gubernamentales y recortar hasta el mínimo la inversión pública, provocando un superávit fiscal que se mantuvo por los primeros diez meses del año 2021.
Un aspecto preocupante es el crecimiento de la inflación que hasta octubre era de 7.7% acumulada, producida fundamentalmente por factores externos. Así como también los niveles de endeudamiento.
Para terminar el año vemos como un logro positivo la terminación del acuerdo del contrato abusivo y lesivo conocido como el peaje sombra.
Endurecimiento de la política migratoria y violación a los Derechos Humanos
La Dirección General de Migración endureció la política migratoria, de manera particular contra la población haitiana llegando a violar derechos fundamentales como el derecho a la salud. Estas medidas provocaron exacerbar el odio de los ultranacionalistas y crear un clima de intolerancia hacia los inmigrantes haitianos, teniendo su punto culminante con el apresamiento y deportación de mujeres embarazadas que acudían a hospitales y recintos de salud para chequeos médicos y partos, sin respetar su dignidad ni importar el tiempo que tuvieran viviendo en el país.
El director de Migración, Enrique García, llegó a decir públicamente que él las sacaba hasta de debajo de las camas. Tan groseras fueron las violaciones a los derechos humanos de las mujeres haitianas, que la Comisión Interamericana de Derechos Humanos (CIDH) se vio obligada a hacer una declaración advirtiendo a las autoridades de las violaciones a los tratados y convenios internacionales que se estaban cometiendo desde República Dominicana. Participación Ciudadana se pronunció en su momento para condenar acciones tan indignas, sobre todo cometidas por funcionarios de un país como la República Dominicana que tiene alrededor de dos millones de sus ciudadanos viviendo fuera de su territorio.
Otro aspecto negativo es la falta de equilibrio de género en el Estado. Desde la constitución de su gabinete, el presidente incumplió con la promesa planteada en su programa de gobierno. Hoy la realidad sigue siendo la misma; la cantidad de ministerios donde la gran mayoría son hombres en las direcciones e instituciones descentralizadas. Hemos visto posiciones en el Congreso que vulneran los derechos de las mujeres como la discusión del Código Penal y las declaraciones de funcionarios que también violentan los derechos de las mujeres, como es el caso de la desafortunada declaración del director la Policía Nacional.
Como ha ocurrido desde hace años, la prensa dominicana, especialmente las y los periodistas de investigación han jugado un papel estelar en la denuncia y documentación de los casos correspondientes a la actual gestión. A ellos va el reconocimiento de Participación Ciudadana.
Los retos del 2022
Mas allá de las promesas de diferentes reformas que se están diseñando en el Consejo Económico y Social (CES), algunas de las cuales tienen vital importancia como la reforma de la Policía Nacional, la reforma del sistema electoral, la seguridad social, la reforma constitucional para consignar la independencia del Ministerio Público, la del sector eléctrico, entre otras, queremos señalar que la profundización de lo iniciado en el presente año es el principal reto.
El fin de la impunidad debe traducirse en sentencias contra todos aquellos que resulten culpables de los delitos. Deberán ampliarse las investigaciones y sometimientos a todos los funcionarios públicos que, en las últimas décadas se han apoderado de los recursos públicos. Fortalecer las instituciones de educación, prevención, control y persecución de la corrupción es el mejor legado que puede dejar al país el presente gobierno.
La recuperación de la economía nacional que todavía es un reto muy fuerte, frente a las secuelas de consecuencias mundiales que ha dejado la pandemia del COVID-19 es un gran desafío que, sin dudas, consumirá los esfuerzos del gobierno y de los sectores productivos. Pero, al tiempo de recuperar el crecimiento y dinamismo el país requiere cambios estructurales que disminuyan las desigualdades, mejoría de la educación pública, acceso a la salud y seguridad social de los sectores más carenciados.
A nivel legislativo, se hacen necesarios marcos regulatorios que fortalezcan la institucionalidad, el uso adecuado de los recursos públicos y los derechos humanos, como la Ley de Publicidad Estatal, modificación a la Ley de Tráfico y Trata de Personas, Ley de Compras y Contrataciones, Ley de Extinción de Dominio y Ley de Cámara de Cuentas.
Participación Ciudadana expresa su voluntad de seguir aportando su cuota en el fortalecimiento de la democracia, en la lucha contra la corrupción y en la defensa de los derechos ciudadanos. En especial, aspiramos a la reforma de las leyes electoral y de partidos políticos. Un control efectivo de los partidos políticos para dejar atrás la época en que estas instituciones son utilizadas por personas que solo quieren llegar al poder para su propio provecho.
Un gran saludo navideño para el pueblo dominicano reconociendo el esfuerzo realizado este año para cumplir con la responsabilidad ciudadana de vacunarse y mantener el distanciamiento social, pero sobre todo por seguir siendo veedores, ejerciendo el control social.
