SANTO DOMINGO, 22 de marzo 2021- El Juez Presidente del Tribunal Superior Electoral (TSE), Marcos A. Cruz García, explicó durante su participación en el programa Matinal 5, transmitido por Telemicro, el proceso de escogencia para los nuevos jueces que integrarán esta alta corte, a partir del próximo 21 de julio del año en curso.
Informó que hasta la fecha no conoce la intención de que los actuales jueces presenten candidatura y en su caso, expresó que plantearía su aspiración para participar en la escogencia del nuevo pleno, llegado el momento.
Indicó que, para tales fines, el Consejo Nacional de la Magistratura (CNM) abre una convocatoria e invita a los interesados a depositar sus expedientes, los cuales se someten a entrevistas, luego de agotada esta fase, escoge a los jueces que integrarán esta alta corte.
Proceso de Rectificación de Actas del Estado Civil
El Magistrado Cruz García expresó que en la actualidad esta alta corte ha fallado de manera rápida los casos de rectificación de actas de estado civil correspondientes al año 2020, el mismo que al verse afectado por la pandemia provocó una ralentización de las operaciones del Tribunal.
Asimismo, durante su participación, explicó que, en el área contenciosa electoral, el TSE está trabajando en ochocientas (800) sentencias pendientes de motivación del pasado proceso electoral.
El Magistrado Cruz García afirmó que, “estamos concluyendo un procedimiento que permita, de manera digital, que los expedientes que reciben las Juntas Electorales en los municipios se puedan enviar al TSE y de esta manera los usuarios puedan consultar sus casos de forma telemática.
El Juez Presidente de esta alta corte consideró que, aunque se ha hablado de dividir las Juntas Electorales en contenciosas y administrativas, esto no es posible, porque se tendría que modificar la Constitución de la República, debido a la naturaleza jurídica de estos.
Reforma Ley Electoral y Ley de Partidos Políticos
Con relación a una reforma a la Ley Electoral y a la Ley de Partidos Políticos, planteada por la Junta Central Electoral (JCE), el Juez Presidente del TSE explicó que, lo ideal es que se disponga de un código electoral con toma de conciencia de los actores políticos, para concentrar toda la legislación en un solo texto.
El Magistrado Cruz García, afirmó que “en el caso del régimen electoral, que también sanciona en materia penal, le correspondería al TSE, participar en cualquier proceso de reforma, ya que la JCE no conoce la parte procesal penal electoral
