Santo Domingo. 29-01-2021.- El Senado de la República aprobó este viernes en única lectura y en una sesión extraordinaria, la ley que amplía el período de Exenciones Fiscales Contemplado en la Ley No. 28-01 que crea una Zona Especial de Desarrollo Fronterizo.
La senadora Faride Raful (Distrito Nacional) solicitó al Pleno Senatorial que esta pieza sea incluida en el orden del día de la presente sesión y liberada de trámite. La pieza fue aprobada con los 28 senadores presentes en la sesión de hoy.
Durante su intervención en la sesión la legisladora Raful informó que los miembros de la comisión decidieron no acoger las modificaciones realizadas por la Cámara de Diputados a la citada iniciativa.
La pieza legislativa tiene como objetivo extender el período de exenciones fiscales otorgado a las empresas clasificadas por la Ley No. 28-01, del primero de febrero del 2001, que crea una Zona Especial de Desarrollo Fronterizo, que abarca las provincias Pedernales, Independencia, Elías Piña, Dajabón, Monte Cristi, Santiago Rodríguez y Bahoruco, modificada por la Ley No. 263-05 de fecha 5 de abril 2005.
El proyecto señala además, que se fija para las empresas instaladas y a instalarse en las provincias señaladas una reducción del 50 % de cualquier otro impuesto, tasa o contribución vigente a la fecha o que se establezcan en el futuro, mientras estén vigentes los 30 años de las exenciones contempladas en esta Ley.
Esta Ley contempla además que las empresas industriales, agroindustriales, agropecuarias, metalmecánicas, de zonas francas, turísticas, metalúrgicas y energéticas, y de todo tipo de empresas permitidas por las leyes dominicanas establecida y que se establezcan en el futuro y que operen dentro de los límites de las provincias de Pedernales, Independencia, Elías Piña, Dajabón, Monte Cristi, Santiago Rodríguez y Bahoruco, disfrutarán de una exención de un cien por ciento del pago de impuestos internos, de aranceles aduaneros sobre materia primas, equipos y maquinarias.
La Ley No. 28-01 establece plazos para el disfrute de las exenciones tributarias dispuestas en la misma, de forma que el próximo 1 de febrero se agotaría el período de exención fiscal para las empresas acogidas a ese régimen especial.
La pieza legislativa vuelve a la Cámara de Diputados que deberá conocer el proyecto original como fue sancionado y presentado por los senadores antes del 1 de febrero del 2021.
Este proyecto es de la autoría de los senadores Dionis Sánchez (Pedernales); Antonio Marte (Santiago Rodríguez); y David Sosa (Dajabón), que tiene dos puntos de diferencias con la Ley 28-01: la extensión del plazo vigente y la reconfiguración del consejo directivo que la regirá.
Previó a la aprobación de este proyecto el presidente de la Cámara Alta, Eduardo Estrella (Santiago), agotó un turno y destacó la labor realizada por la Comisión de Hacienda del Senado.
“Como defensor de la frontera dominicana es sumamente importante y vital en una situación como la que vive el país aprobar esta ley. No se podía dejar desprovista de esta ley la frontera del país”, apuntó.
“El Senado de la República y la Cámara de Diputados, en un Gobierno de Luis Abinader, no podía dejar que esta ley perimiera. Yo le prometí a Faride y a Dionis que sesionaríamos hoy y aquí estamos”, señaló Estrella.
Los senadores sancionaron, también, en única lectura el contrato de préstamo suscrito entre la República Dominicana y el Banco Interamericano de Desarrollo (BID) para el financiamiento del Programa de Expansión de Redes y Reducción de Pérdidas Técnicas Eléctricas en Distribución por un monto de 155 millones de dólares.
Esta pieza tiene el objetivo apoyar la primera etapa del Plan Maestro para la Expansión del Sistema de Distribución en la Empresa Distribuidora de Electricidad del Sur (EDESUR), mediante la reducción de pérdidas técnicas, ofreciendo mayor continuidad y calidad del abastecimiento a través de la construcción de nuevas subestaciones de distribución y sus puntos asociados y rehabilitación.
La iniciativa, remitida por el Poder Ejecutivo, fue sancionada con el voto favorable de 18 senadores de 27 que estaban presentes en ese momento.
En única lectura los legisladores sancionaron varios nombramientos diplomáticos entre los que figuran el de Lourdes Gisela Antonia Victoria-Kurse, como embajadora ante la República Eslovaca.
Además, el nombramiento diplomático de Angie Shaquira Martínez Tejeda, en Jamaica, y el nombramiento de Manuel Ernesto Polanco Salvador ante la República de Paraguay.
En la sesión los senadores ratificaron también el nombramiento diplomático de Fausto Rafael Liz Quiñones en la República de Chile y ratificaron el nombramiento diplomático de Miguel Ángel Prestol González en la República Portuguesa. También fue sancionado el nombramiento de Claudio Miguel Marte González, ante el Estado Plurinacional de Bolivia.
En segunda lectura fue conocido el proyecto de ley que designa con el nombre de “Juan Ramón Díaz” el liceo secundario del Distrito Municipal Yerba Buena, provincia Hato Mayor, iniciativa del senador doctor Cristóbal Castillo.
En la sesión de este viernes los senadores sancionaron, además, una resolución que solicita al administrador del Banco de Reservas y a su Consejo Directivo la instalación y apertura de una sucursal de esta entidad financiera en el municipio de Cevicos, provincia Sánchez Ramírez, de la autoría del Ricardo de los Santos.
También la que solicita al administrador del Banco de Reservas la instalación de una sucursal en el municipio de Hondo Valle, provincia
Elías Piña, de la autoría del senador Aris Yván Lorenzo.
Los senadores sancionaron una resolución que solicita al administrador del Banco de Reservas la instalación de una sucursal en el municipio de Arenoso, en la provincia Duarte, de la autoría del senador Franklin Romero.
Los senadores guardaron un minuto de silencio por el fallecimiento de la señora Nidia Altagracia Gómez, madre del senador por la provincia de Monte Cristi, Ramón Pimentel. La solicitud la hizo el senador Héctor Acosta (Monseñor Nouel).
El contenido del Reglamento 01-2021 de la Junta Central Electoral (JCE), sobre la distribución de la contribución económica del Estado a los partidos, agrupaciones y movimientos públicos, concentró los debates de los senadores durante el turno de ponencia, ya que la bancada de la Fuerza del Pueblo (FP), encabezada por su vocero, el senador Dionis Sánchez (Pedernales), consideró que el organismo comicial no aplicó la ley correctamente al momento de determinar cuáles eran los partidos que serían considerados como minoritarios para reconocer dos partidos mayoritarios: el Partido Revolucionario Moderno (PRM) y el Partido de la Liberación Dominicana (PLD).
De su lado, el vocero de la bancada del PLD, Aris Yván Lorenzo (Elías Piña) respaldó la decisión de la JCE al considerar que hizo una correcta administración de la justicia.
En tanto, el senador del Partido Reformista Social Cristiano (PRSC) Ramón Rogelio Genao (La Vega) consideró que debió considerarse la sumatoria de los cuatro niveles para establecer las reglas del financiamiento.
Mientras el representante de la provincia Valverde, Eddy Nolasco, pidió acelerar la elección del sustituto de la fallecida diputada Zaida Polanco, y expresó su deseo de que se elija una persona “para defender los intereses de nuestro querido pueblo”.
En otro orden, el senador Héctor Acosta (Monseñor Nouel) pidió al ministro de Medio Ambiente, Orlando Jorge Mera, visitar su provincia para emprender acciones que detengan el deterioro del río Yuna. También felicitó al director de la Empresa Distribuidora de Electricidad del Norte (EDENORTE) por disponer del alumbrado del entorno del recién inaugurado Hospital Pedro E. de Marchena, en Bonao.
El senador Cristóbal Castillo (Hato Mayor) motivó la aprobación de una resolución que solicita al Servicio Nacional de Salud (SNS) y al Ministerio de Obras Públicas (MOPC) la construcción de un centro de atención primaria y de diagnóstico que beneficie a los municipios de Sábana de la Mar, El Valle y Elupina Cordero.
Al final del turno de ponencias, el presidente del Senado de la República, Eduardo Estrella, aclaró que el partido que representa, Dominicanos por el Cambio, propuso en las discusiones en el seno de la JCE tomar el promedio general para asignar el financiamiento, contrario a la propuesta de FP de que se escogiera el nivel donde el partido obtuvo la mayor votación.
Rechazó haber ejercido algún tipo de influencia en la decisión tomada por la JCE y aclaró que en las pasadas elecciones no aceptó un centavo de Dominicanos por el Cambio para financiar su campaña. “En lo personal no me interesa a quién le dan más o menos”, acotó.
