Senado convoca a Luis Henry Molina y miembros del Poder Judicial para que expliquen problemas de audiencias virtuales

La propuesta del representante de la provincia Santo Domingo, Antonio Taveras Guzmán, el Senado de la República convocó al presidente y a los miembros del Poder Judicial para que informen a la Cámara Alta sobre las irregularidades que se están presentando en la gestión del sistema de Justicia durante la crisis del COVID 19.

De manera específica, el Senado convoca al presidente Luis Henry Molina y a los miembros Nancy Salcedo Fernández, Leonardo Recio, Estalinao Radhames Rodríguez y Fernando Fernández Cruz para que ofrezcan informaciones sobre las medidas administrativas adoptadas en los meses recientes para impartir procedimientos y resoluciones judiciales por la vía virtual.

En sus consideraciones, la resolución presentada por Antonio Taveras Guzmán cita los cuestionamientos de los que ha sido objeto el Consejo del Poder Judicial por parte de la comunidad de operadores del sistema.

“Se ha cuestionado que el Consejo del Poder Judicial ha tomado dichas medidas administrativas sin existir medidas legales que le atribuyan dicha facultad, lo cual derivó en un procedimiento ante el Tribunal Superior Administrativo que culminó con una sentencia que ordenó establecer los servicios judiciales por la vía presencial”, indica la iniciativa legislativa aprobada en la sesión ordinaria de este miércoles 25 de noviembre.

La convocatoria del Senado a los integrantes del Poder Judicial se sustenta, además, en el artículo 94 de la Constitución de la República, el cual indica que: las cámaras legislativas, así como las comisiones permanentes y especiales que éstas constituyan, podrán invitar a ministros, viceministros, directores y demás funcionarios y funcionarias de la Administración Pública, así como a cualquier persona física o jurídica, para ofrecer información pertinente sobre los asuntos de los cuales se encuentren apoderadas.
