Denunció que el alcalde modificó el pliego de condiciones con el presunto propósito de favorecer a una compañía sin experiencia y cuya función comercial es otra

SANTO DOMINGO, R.D. El presidente de la  Fundación Primero Justicia, Miguel Surún Hernández, impugnó este jueves ante la Dirección General de Compras y Contrataciones Públicas, la adjudicación de la compañía para la recogida de basura realizada por la Alcaldía de Santo Domingo Este (ASDE) por un monto de RD$2,400 millones de pesos, alegando de que hubo serías irregularidades en el  proceso de licitación.

Surun Hernández, quien  también presidente del Colegio de Abogados de RD, denunció que en el proceso de licitación se registró una sospechosa variación del pliego de condiciones en beneficio de la empresa adjudicataria Xenakis Investment, S.A.

“Estamos en presencia de un procedimiento  plagado de anomalías primero por su declaratoria de urgencia en violación al artículo 6 de la  de la Ley 340-06, de Compras y Contrataciones,  ya que dicho proceso no reunía los paramentos mínimos para ser declarado de esta manera», indicó el jurista. 

Señaló además que dos días antes del cierre del plazo para depósito de ofertas, el alcalde Manuel Jiménez varió el pliego de condiciones aprobado por Comité de Compras de la institución y ratificado por la Sala Capitular, quienes habían requerido que los camiones sean del 2020 en adelante y el alcalde lo modificó disponiendo que sean del 2014 en adelante, sin la anuencia del Concejo de Regidores, con el presunto objetivo de favorecer a dicha empresa, según el jurista.

El presidente de la Fundación Primero Justicia expresó que otro aspecto cuestionable del proceso fue la eliminación del requisito para que los licitadores tengan centro de operación en el municipio y calificó como muy grave que la empresa adjudicataria Xenakis Investment, S.A., aparte de no tener experiencia en labores de recogida de los desechos sólidos, tiene como función principal la comercialización y promoción de bienes e inmuebles.

“Partiendo de esta realidad, calificamos como ilegal, irregular e irracional que se otorgue un contrato de 2,400 millones de pesos, a través de la obligación de pago de 26 dólares por toneladas, a una compañía seleccionada durante un proceso cuestionable», aseguró Surun Hernández. 

El abogado dijo que al modificar el pliego de condiciones el alcalde Manuel Jiménez actuó de manera unilateral, por cuenta propia y en abierto desafío al Concejo de Regidores del ASDE, con el presunto propósito de que ganara  una empresa en especial.
